Ticketing Terms & Conditions and Privacy Statement

Event: 10th Anniversary Pasifika Festival in the Bay 2026

Event Date: Saturday 31 October 2026

Postponement Date: Saturday 7 November 2026

Venue: Tauranga Girls' College

Promoter: Pasifika in the Bay Trust

Ticketing Platform: Flicket Limited

These Terms and Conditions apply to tickets purchased or issued for the 10th Anniversary

Pasifika Festival in the Bay 2026 ("Festival").

Pasifika in the Bay Trust ("PITBT"

"we", "us" or "our") is the organiser and promoter of the

Festival. Flicket Limited ("Flicket") provides the online ticketing platform used for the Festival.

By purchasing, accepting or using a Festival ticket, you agree to these Terms and

Conditions.

1. Tickets and Entry

A valid Festival ticket issued through Flicket must be presented for entry to the Festival.

Tickets may be presented electronically on a mobile device or in another valid format

provided by Flicket.

Tickets must not be duplicated, altered, fraudulently reproduced or resold for commercial

gain. PITBT reserves the right to refuse entry where a ticket is invalid, has already been

scanned, or there are reasonable grounds to believe it has been obtained or used

fraudulently.

Where Flicket permits a ticket to be transferred or renamed, the transfer will be subject to

Flicket's applicable processes and conditions.

Ticket holders must follow the reasonable directions of Festival staff, security personnel,

volunteers and authorised representatives while attending the Festival.

2. Children, Young People and Families

Pasifika Festival in the Bay is a family and community event, and children and young people

are warmly welcomed.

Parents, caregivers and supervising adults remain responsible for the care and supervision

of children in their care while attending the Festival.

Where a ticket category has an age requirement, PITBT may request reasonable evidence

of age.

1

Children must not be left unsupervised where their age or circumstances reasonably require

adult supervision.

School groups, performers and other organised groups participating in the Festival may also

be subject to separate registration, supervision, health and safety, photography and consent

requirements arranged with PITBT.

3. Postponement, Cancellation and Refunds

The Festival is scheduled for Saturday 31 October 2026.

If weather, safety considerations or circumstances beyond PITBT's reasonable control mean

the Festival cannot safely proceed on that date, PITBT may postpone the Festival to the

advertised postponement date of Saturday 7 November 2026.

Tickets purchased for 31 October 2026 will automatically remain valid for the advertised

postponement date of 7 November 2026.

By purchasing a ticket, ticket holders acknowledge that 7 November 2026 is the Festival's

advertised postponement date. A postponement from 31 October 2026 to 7 November 2026

will not, by itself, entitle a ticket holder to a refund, except where required by law.

If the Festival is cancelled and does not proceed on either the scheduled date or the

advertised postponement date, ticket purchasers will receive a full refund of the amount paid

for their ticket, including the applicable Flicket booking fee, in accordance with New Zealand

consumer law.

Where Flicket's booking fee has already been deducted from ticket sales and is not

refundable to PITBT, PITBT will meet that cost so that the ticket purchaser receives the full

refund to which they are entitled.

Unless required by law or expressly stated otherwise, refunds will not normally be provided

  • because a ticket holder:
  • changes their mind;
  • is unable to attend;
  • arrives after Festival activities have commenced;
  • leaves the Festival early; or
  • is refused entry or removed from the Festival because they have breached these
  • Terms and Conditions.

Nothing in these Terms and Conditions limits or excludes any rights or remedies available to

consumers under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other

applicable New Zealand law.

4. Changes to the Festival Programme

A ticket provides admission to the Festival as a whole and is not purchased for a particular

performer, school, cultural group, artist, activity or programme item.

Pasifika Festival in the Bay is a large community event involving schools, performers,

stallholders, community organisations and external partners. Programme times and

participants may therefore change.

2

PITBT reserves the right, where reasonably necessary, to alter Festival schedules,

performances, activities, locations within the Festival site or other programme elements.

A change to an individual performance, performer, activity or programme time will not

ordinarily entitle a ticket holder to a refund.

5. Conditions of Entry and Behaviour

The Pasifika Festival in the Bay is intended to be a safe, welcoming and inclusive

celebration of Pacific cultures, communities, languages, education and creativity.

Everyone attending the Festival is expected to behave respectfully towards performers,

tamariki and rangatahi, families, stallholders, volunteers, Festival personnel and other

attendees.

PITBT may refuse entry or require a person to leave where there are reasonable grounds to

believe that the person:

  • is behaving in a violent, threatening, abusive, discriminatory, unsafe or seriously
  • disruptive manner;
  • is intoxicated or under the influence of illegal drugs;
  • possesses a prohibited or dangerous item;
  • interferes or tampers with Festival activities, performers or other attendees;
  • fails to comply with reasonable safety or security directions; or otherwise presents a risk to themselves or others.

No refund will normally be provided where a person is lawfully removed or refused entry

because of their conduct.

6. Health, Safety and Security

The health, safety and wellbeing of our Festival community is important to PITBT.

Normal road rules apply. All vehicles must have a maximum speed limit of 10km per hour at

all times when on the field and school grounds. All passengers must wear seat belts while

the vehicle is in motion. No passengers are permitted to sit and travel on vehicles or the

back of utes or trailers.

All items you bring must be legally compliant eg: vehicles; trailers; LPG bottles. You will be

asked to leave the festival if you bring any unsafe items with you.

Festival attendees must follow reasonable instructions from Festival staff, security

personnel, emergency services and authorised representatives.

PITBT may undertake reasonable bag or security checks where necessary for Festival

safety. A person who does not consent to a reasonable security check may be refused entry.

In an emergency, attendees must follow the directions of the Festival operations team and

emergency services. Our Festival operations team will be wearing pink high visibility vests.

Traffic Management will also be assisting with our Festival.

PITBT may arrange first aid, emergency assistance or other reasonable measures where

considered necessary to protect a person's health or safety.

3

Attendees should take reasonable care of themselves, children in their care and their

personal belongings while at the Festival.

7. Alcohol, Smoking, Vaping and Illegal Drugs

Pasifika Festival in the Bay is an alcohol-free event.

Smoking and vaping are not permitted within the Festival site except in any specifically

designated area approved by the venue and PITBT.

Illegal drugs and substances are prohibited.

A person possessing, supplying or consuming illegal drugs may be removed from the

Festival and the matter may be referred to New Zealand Police.

8. Food and Drink

Attendees may bring reasonable food and non-alcoholic drinks into the Festival unless

otherwise advised for health, safety or venue reasons.

The Festival also includes food and beverage stallholders.

Attendees with allergies or dietary requirements are responsible for making appropriate

enquiries directly with individual food vendors before purchasing or consuming food.

9. Prohibited Items

For the safety of our Festival community, the following must not be brought onto the Festival

  • site:
  • alcohol;
  • illegal drugs or substances;
  • firearms, weapons or items intended to be used as weapons;
  • explosives, fireworks, flares or other dangerous pyrotechnics;
  • dangerous or flammable substances;
  • drones unless expressly authorised by PITBT;
  • unauthorised commercial or promotional materials; and
  • any other item Festival personnel reasonably consider dangerous or likely to create a significant safety or health risk.

PITBT may require prohibited items to be removed from the Festival site and may refuse

entry where appropriate.

This does not prevent performers, stallholders, contractors or authorised Festival

participants from bringing equipment or materials approved by PITBT for their Festival

activities.

10. Photography, Filming and Livestreaming

Pasifika Festival in the Bay is a public community event.

Official photographers, videographers and media personnel may photograph, film, livestream

and record Festival activities on behalf of PITBT.

4

These images and recordings may be used by PITBT for purposes connected with the

Festival and the Trust's charitable activities, including reporting to funders and partners,

Festival promotion, websites, social media, publications, historical records and promotion of

future Pasifika in the Bay Trust programmes and events.

Because the Festival includes tamariki and rangatahi, PITBT will take reasonable steps to

respect applicable school, group and individual photography or media consent arrangements

that have been communicated to PITBT.

Parents, caregivers, schools and participating organisations remain responsible for

communicating any relevant photography or media restrictions to PITBT through the

appropriate Festival registration or consent process.

Attendees may take photographs and short recordings for personal and non-commercial

use, provided this is done respectfully and does not interfere with performances,

compromise safety or unreasonably infringe the privacy of others.

Commercial photography, professional filming, media coverage, livestreaming or recording

for commercial purposes requires prior approval from PITBT.

11. Accessibility and Service Animals

PITBT aims to make the Pasifika Festival in the Bay welcoming and accessible.

Registered disability-assistance dogs and other service animals permitted by law are

welcome at the Festival.

People with accessibility requirements are encouraged to contact PITBT before the Festival

where specific assistance or information is required.

12. Personal Property

Attendees are responsible for their own personal property while attending the Festival.

To the extent permitted by law, PITBT is not responsible for loss, theft or damage to personal

property unless that loss or damage results from something for which PITBT is legally liable.

Lost property handed to Festival staff will be managed through the Festival's lost-property

process. Report to the main information desk.

13. Liability and Consumer Rights

PITBT will take reasonable care in organising and delivering the Festival.

Attendees must also take reasonable care for their own safety and the safety of children or

other people under their supervision.

To the maximum extent permitted by law, PITBT is not liable for loss or damage arising from

circumstances outside its reasonable control or from an attendee's own actions, negligence

or failure to follow reasonable Festival directions.

Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy

that cannot lawfully be excluded under New Zealand law.

14. Events Beyond Our Reasonable Control

5

PITBT may postpone, cancel, relocate, suspend or modify all or part of the Festival where

reasonably necessary because of circumstances beyond its reasonable control.

These may include severe weather, natural disaster, fire, public-health emergency, epidemic

or pandemic, government direction, civil emergency, significant infrastructure or utility failure,

venue closure, security threat or another event that makes holding the Festival unsafe,

unlawful or impracticable.

Where this occurs, PITBT will communicate changes to ticket holders as soon as reasonably

practicable and will meet its obligations under applicable New Zealand consumer law.
